Ben Foster was considered for the parts of both brothers (Kenny and Peter). Unfortunately, due to filming conflicts from The Program (2015), and a confirmed report that the casting director and producers were leaning towards Ben playing the smaller role of Peter, he decided to stick to The Program (2015), as the star of the movie. When Ben was asked about if it was him being the star compared to a limited scene, smaller co-star role in Tombstones, Ben joked "No fu*king sh*t Sherlock!" But did say he was willing to do both, only if he got to play the smaller role of Peter, so he didn't have to worry about scheduling conflicts and not working as much. They ended up choosing Boyd Holbrook over Foster, and he immediately pulled out.
Danny Ortiz:
You need some help, man.
Matt Scudder:
Oh, God.
Danny Ortiz:
I don't care. You want to mess up your own shit - but you're going to mess up mine, too. I need to know you got my back. Not that you're going to come falling through the door behind me...
Matt Scudder:
Don't worry your pretty ...
Danny Ortiz:

At the beginning of the movie Scudder is firing an M1911 pattern pistol at the fleeing robber. There is no similar weapon on the approved carry list for a regular (carrying a badge and not undercover) officer of the NYPD.
The offending scene cut from the film (so it could be rated 15 instead of 18) features the two villains tormenting and sexually threatening a restrained woman in the back of a van. The British censors felt this scene lingered on the nastiness and detail, and was disturbing. The UK distributor removed the small scene and got their desired 15 rating.
