Max Hass is an entertainment, intellectual property, and business attorney based in Denver, CO. He holds law licenses in three states (Colorado, Louisiana, and New York) and is passionate about working with creators and helping entrepreneurs build and grow their businesses through legal protection and holistic counseling and advice. Max is also a creative person himself, and comes from a family of creatives: he has played bass since age 11 and is currently a working musician in the Denver music scene, and has worked on a number of film productions in a variety of behind-the-scenes support roles. He is originally from upstate New York and maintains many ties to New York while living in Colorado; he attended University of Pennsylvania for his Bachelor's degree and Tulane University for law school. He began his legal career in New Orleans, shortly after graduating high school. The main areas of his practice include: music, film, trademarks, business formation, and cannabis advertising.
For filmmakers, Max provides a range of services from basic contract review to pitching scripts to full production legal. Bringing a deep knowledge of copyright and contract law from his experiences in the music world, Max is well versed in the legal and business issues affecting film producers. His familiarity with the film industry goes beyond his legal work - Max has worked as a production assistant on a few projects, and has assisted his brother (a cinematographer based in New York) on many of his projects. Max's first legal work in the film industry was serving as assistant production counsel for the 2017 film Class Rank, and he has assisted a number of independent filmmakers since. Examples of Max's work in this area include: negotiation of distribution agreements, preparation of crew deal memos, negotiation of talent and director's agreements, music clearance, location clearance, preparation of individual and crowd releases, counseling on union obligations, negotiation of writer's agreements and option agreements, copyright registration, and trademark registration. Max has also handled some litigation in this space, representing some Colorado-based filmmakers in a California breach-of-contract case in 2021.
In the music industry, Max works extensively with artists and songwriters as a passionate advocate for the protection and fair treatment of artists. He has also represented and advised record labels, artist managers, streaming platforms, producers, dancers, among others. Examples of work Max has done in this area include: sample clearance, negotiating producer deals, setting up record labels with operating agreements and recording artist agreements, advising on PRO licensing and royalty collection, negotiating songwriter/publishing agreements, copyright registration, and copyright licensing. Max is also a skilled federal litigator, and has handled both copyright and trademark infringement cases (from both sides, plaintiff and defense) in federal courts in New York City, Colorado, and New Orleans. Prior to launching his law practice in late 2017, Max worked with a number of independent musicians in New Orleans as a manager, booking agent, promoter, and member of a few bands. Because of this expertise, he often counsels musician clients on a range of music-business topics beyond the legal issues. In addition to working with musicians, Max has also worked with a number of aerial performers, dancers, and other performance artists.
